BLACK JACK TECHNOLOGY TERMS AND CONDITIONS

Introduction to the Terms and Conditions

This document sets out the rules and guidelines governing the use of our services and products. By accessing and using our services, you agree to comply with these terms.   1.  Invoicing and Tax Credit
    1. Invoices issued by Black Jack Technology do not generate tax credits and are solely for administrative purposes and to confirm payment for the services and products provided.
  3. Delivery of Licenses and Software
    1. Purchased licenses and software will be delivered by email within 48 business hours after full payment is confirmed, unless otherwise stated in the service contract.
  5. No-Refund Policy
    1. Once invoicing has been completed and the contracted software or service has been delivered, the payment cannot be refunded. We recommend confirming the service requirements and terms before making a purchase.
  7. Accepted Payment Currencies
    1. Payments are accepted only in Guatemalan quetzals (GTQ) and U.S. dollars (USD). The customer is responsible for any exchange-rate charges or bank fees applicable to the transaction.
  9. Legal Compliance
    1. Black Jack Technology does not sell, distribute, or participate in the marketing of illegal or unlawful (pirated) software, nor does it provide IT services that violate applicable laws.
  11. Use of Services and Customer Responsibilities
    1. The customer is responsible for providing accurate information and following Black Jack Technology’s security recommendations to maximize the effectiveness of the services. A lack of cooperation or accuracy in the information provided may affect service performance without making Black Jack Technology liable for that effect.
  13. Intellectual Property and Licenses
    1. All intellectual property rights in the software, manuals, documents, and any other materials supplied by Black Jack Technology are the exclusive property of the company or its licensors. The customer receives only the usage rights strictly necessary and may not modify, redistribute, or copy the materials without express authorization.
  15. Confidentiality and Data Protection
    1. Black Jack Technology guarantees the confidentiality of information provided by the customer and undertakes to handle personal and sensitive data in accordance with applicable data-protection regulations. Both the customer and the provider agree not to disclose confidential information to third parties without prior agreement.
  17. Limitation of Liability
    1. Black Jack Technology is not liable for indirect, incidental, special, or consequential damages arising from the use of its services or software. The company is limited to providing recommendations and technical solutions, while implementing and complying with those recommendations remain the customer’s responsibility.
  19. Changes to Services and Terms
    1. Black Jack Technology reserves the right to modify or update its services and these terms when necessary to adapt to technological or regulatory changes. The customer will be notified promptly of significant changes.
  21. Warranty and Exclusions
    1. Products and services are provided “as is” without additional warranties, except as specifically stipulated. Black Jack Technology does not guarantee complete protection against all cyber threats because of their evolving nature.
  23. Payment and Invoicing Terms
    1. Payments must be made according to the conditions stated on the invoice. Black Jack Technology may suspend the service if payment obligations are not met or if the customer requests activities outside the service’s original scope.
  25. Termination of Services
    1. Black Jack Technology reserves the right to terminate or suspend services if these terms are violated, payment is not made, or the customer is found to be using the services illegally or contrary to these Terms and Conditions.
  27. Dispute Resolution
    1. In the event of a dispute or disagreement, both parties agree to attempt to resolve the matter through mediation before taking legal action. The applicable jurisdiction will be that of the location of Black Jack Technology’s headquarters, unless otherwise agreed.
  29. Severability
    1. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  31. Audit Rights
    1. Black Jack Technology may conduct periodic audits or technical reviews at the customer’s site if deemed necessary to ensure compliance with security recommendations and the integrity of the services provided.
